Anonymous 911 caller’s plea for police assistance justifies investigatory detention of hostage-taking suspect

SEARCH & SEIZURE
United States v. Brown,
No. 05-2319, ___ F.3d ___ (10th Cir. Jul 24, 2007)(New Mexico).

Appeal of conviction for being felon in possession of firearm in violation of 18 U.S.C. § 922(g)(1).

HELD: Information provided by anonymous 911 caller seeking police assistance for friend bore sufficient indicia of reliability to justify investigatory detention of defendant. Indicia of reliability included: (1) caller’s lack of true anonymity; (2) contemporaneous firsthand knowledge; (3) stated motivation for seeking police intervention; (4) limited police corroboration of facts provided by caller.
